10-YEAR MATTRESS LIMITED WARRANTY

This Warranty is valid only for the original purchaser from the original purchase date and is non-transferable. The “original purchaser” is the first purchaser of the mattress from Bamboo is Better. Please retain a copy of your receipt as proof of purchase and ownership.

If the original purchaser sells or otherwise transfers ownership, this Warranty terminates and the subsequent owner accepts the product “as is” and “with all faults.”

This Warranty extends to mattresses manufactured by Diamond Mattress for Bamboo is Better and purchased directly from Bamboo is Better (including the mattress cover sold with the mattress). It covers defects in materials and workmanship for 10 years from the purchase date.

Replaced or repaired mattresses remain subject to the original Warranty term, which begins on the original purchase date.

• Visible indentations greater than 1.5 inches that are not associated with improper or unsupported foundations/bed bases.
• Foam cracks or splits occurring under normal intended use and proper handling.
• Manufacturing defects in the assembly of the mattress cover (excluding zippers and handles).

• Misuse, neglect, accidents, or violation of care/foundation instructions.
• Normal increase in softness that does not affect performance.
• Comfort preference.
• Damage such as burns, cuts, tears, stains, liquid damage, odors, or unsanitary conditions.
• Wear to fabric including fading, pilling, peeling, or loss of finishing treatments from use.
• Zipper breakage due to use or misuse.
• Mattresses sold as “used,” “preconditioned,” “reconditioned,” “returned,” or otherwise not “new”/first quality.

Normal wear requires continuous support by a suitable foundation or adjustable base with a proper bed frame capable of supporting the combined weight of the mattress and users. Examples include:

• Platform beds with adequate slat spacing (generally ≤ 3") and center support.
• Solid foundations/box platforms designed for foam mattresses.
• Quality adjustable bases compatible with foam mattresses.

Improper support may void coverage for indentations/sagging. Avoid bending, folding, or prolonged compression beyond shipping.

During the 10-year term, Bamboo is Better will, at our discretion, repair, re-cover, or replace your mattress for covered defects. The only costs you may incur are replacement components and transportation/handling fees.

If an identical model is unavailable, we may provide a comparable model of equal or greater value at our discretion.

Please have the following ready:

• Photo of the law tag attached to the mattress.
• Copy of your purchase receipt.
• Photos showing the issue (for indentations, include a ruler/tape measure at the deepest point on a flat surface).
• Brief description of the issue and your foundation/base type.

Email support@bambooisbetter.com or use the form below. After the 100-Night Sleep Trial, you may be responsible for shipping/handling each way for repaired/replaced items. At our option, we may authorize photo evidence in lieu of returning the mattress.

This Warranty gives you specific legal rights; you may have other rights that vary by state/jurisdiction. To the extent permitted by law, this Warranty and the remedies set forth are exclusive and in lieu of all other warranties (express or implied), including merchantability and fitness for a particular purpose. Where such warranties cannot be disclaimed, their duration is limited to the shorter of (a) this Warranty’s duration or (b) the maximum duration permitted by statute. Some states do not allow limitations on implied warranties; the above may not apply.

To the maximum extent permitted by law, Bamboo is Better and its suppliers are not liable for special, incidental, consequential, or indirect damages. Total liability will not exceed the purchase price paid for the mattress giving rise to such liability. Some states do not allow the exclusion or limitation of incidental or consequential damages; the above may not apply.

Disputes arising from this Warranty will be determined by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA). Arbitration will take place in San Francisco, CA. More information: www.adr.org or 1-800-778-7879.

You must seek arbitration for disputes arising out of this Warranty prior to exercising rights under Title I of the Magnuson-Moss Warranty Act (unless pursuing non-Title I remedies). This Warranty is governed by the laws of the State of California.
